Description

This updated annotation of the Powers of Attorney Act 1996 comments on each section in detail and refers to Irish and English case law over the past fourteen years, and the Law Reform Commission Consultation Paper on Law and the Elderly, and its Report on Vulnerable Adults and the Law. Certain aspects of the Land and Conveyancing Law Reform Act 2009 are also commented on. Reference is made to the Land Registry Rules and to the Law Society of Ireland Guidelines on Enduring Powers of Attorney. This edition also includes the Statutory Instruments made under the Act, which prescribe, inter alia, the form of an Enduring Power of Attorney, and reproduces Order 129 of the Rules of the Superior Courts relating to the registration of Enduring Powers of Attorney.
