Die vorliegende Darstellung verbindet den Allgemeinen Teil des BGB erstmals mit dem Handelsrecht. Dieses Konzept beruht auf der Annahme, dass sich praktisch das gesamte examensrelevante Handelsrecht aus dem Allgemeinen Teil des BGB erklären lässt bzw. umgekehrt mitunter Fragen des Allgemeinen Teils durch eine systematische Betrachtung des älteren Handelsgesetzbuches beantworten oder zumindest erhellen lassen. Während der Allgemeine Teil bis hin zu den Problemen der Stiftung, des Vereins oder der Berechnung von Terminen und Fristen etc. zur Gänze dargestellt wurde, begnügt sich die Darstellung der handelsrechtlichen Fragen mit denjenigen Problemen, die nach einer Durchsicht der Examensklausuren der letzten Jahre typischerweise im Rahmen des Pflichtfachstoffs erwartet wurden. Das Buch besteht im Wesentlichen aus Aufsätzen, die in den letzten 12 Jahren für die Zeitschrift JURA verfasst worden sind. Alle Beiträge wurden überarbeitet und mit neuen Nachweisen versehen. Die einzelnen Beiträge wurden von vornherein auf ein großes Ganzes hin konzipiert. Der systematische Zusammenhang zwischen dem Allgemeinen Teil und dem Handelsrecht wird hier eingehend dargestellt.
