Christiane von Bary untersucht den Abschluss von Gerichtsstands- und Schiedsvereinbarungen und berucksichtigt aufgrund der erbrechtlichen Besonderheiten auch einseitige Zustandigkeitsbestimmungen und Schiedsanordnungen. Sie analysiert die im Wortlaut sehr offene Regelung der Europaischen Erbrechtsverordnung zu Gerichtsstandsvereinbarungen und ordnet diese dabei in das System der Verordnung und des europaischen internationalen Zivilverfahrensrechts ein. Zudem werden die sich bei grenzuberschreitenden erbrechtlichen Schiedsverfahren stellenden Fragen des anwendbaren Rechts und der Vollstreckbarkeit unter Ausgleich des unterschiedlichen Stellenwerts der Privatautonomie im Schieds- und Erbrecht einer Losung zugefuhrt. Nicht zuletzt vergleicht die Autorin Gerichtsstands- und Schiedsvereinbarungen, zeigt bestehende Wertungswiderspruche auf und gibt Hinweise zur praktischen Anwendung.
