Das Recht eines Menschen, zur Durchsetzung seiner privaten Rechte vor Gericht zu ziehen und effektiven Rechtsschutz zu erhalten, ist in heutiger Zeit als fester Bestandteil grundrechtlicher Gewahrleistungen anerkannt. Seltener behandelt wird demgegenuber die Frage, ob und bejahendenfalls in welchem Umfang mit dem Erfordernis des Nachweises eigener Rechte im Zivilprozess nach der ZPO zugleich auch ein Recht der Prozessparteien auf einen effektiven Nachweis dieser Rechte einhergeht. Moritz Nissen postuliert ein ebensolches Recht auf Beweis und arbeitet es in seinem Umfang wie auch seinen Grenzen nach dem Grundgesetz, der EMRK und der europaischen Grundrechtecharta heraus. Das so gefundene Recht auf Beweis wird im Anschluss als Maastab fur die Uberprufung der wesentlichen beweisrechtlichen Konstellationen der ZPO herangezogen und auf diese Weise ein handhabbarer Maastab zur Beurteilung des zivilprozessualen Beweisrechts geschaffen.
