Wie in anderen Bereichen der Medizin, die in jüngerer Zeit eine rasante Entwicklung erfahren haben, hinkt auch bei der Transplantation das Recht hintennach. Die vorliegende Studie enthält eine Bestandesaufnahme zu den rechtlichen Aspekten der Transplantation. Nach einem einleitenden, ersten Kapitel widmet sich das zweite Kapitel der entscheidenden Frage des Organmangels. Sodann werden die in der Schweiz geltenden Bestimmungen sowie die gesetzlichen Voraussetzungen für die Vornahme von Transplantationen vorgestellt, gefolgt von einigen Ausführungen zum ausländischen Recht. Das Verhältnis des Sozialversicherungsrechts zur Transplantationsmedizin bildet Gegenstand weiterer Ausführungen. Ebenso wird das System der nationalen Koordination der Transplantationen und der Zuteilung der Organe abgehandelt. Schliesslich werden in einem letzten Kapitel einige Lösungsvorschläge vorgestellt, um die gegenwärtigen Hindernisse im Bereich der Organtransplantationen zu beseitigen.
