Europäische Grundrechte können im Jahr 2010 auf eine sechzigjährige Tradition zurückblicken. Seit 1950 ist nicht nur die Anzahl der Mitgliedstaaten erheblich angewachsen, sondern auch die Beschwerdeflut - unbeschadet organisatorischer Reformen - rapide gestiegen. Erst mit Inkrafttreten des Vertrages von Lissabon im Dezember 2009 hat die Europäische Grundrechtecharta Normativität gewonnen. Mit einem baldigen Beitritt der EU zur EMRK rückt nun ein einheitlicher europäischer Grundrechtsschutz in greifbare Nähe. Der erste Teil des neuen Bandes behandelt zunächst alle in der EMRK verankerten Grundrechte und geht auch auf deren Schutz durch den EGMR ein. Der zweite Teil beinhaltet dann die Grundrechte in der Europäischen Union: die unionsrechtlichen Grundfreiheiten wie auch die EU-Grundrechtecharta bilden hierbei einen Schwerpunkt. Schließlich wird noch der Grundrechtsschutz durch den EuGH erörtert. In den einzelnen Beiträgen sind bereits die Änderungen durch den Vertrag von Lissabon wie auch das gerade in Kraft getretene 14. Zusatzprotokoll der EMRK eingearbeitet. Ein Gesetzesanhang (EMRK, GRCh, EUV, AEUV) sowie ein ausführliches Sachregister machen den Band zu einem für Verfassungspraxis und Wissenschaft unentbehrlichen Nachschlagewerk.
