　　在過去，國家重視經濟發展，開發至上、講求效率；隨著環境保護意識抬頭，永續發展的價值逐漸被重視；當下，國際社會關注的是如何保障原住民族的權利，國家、礦業、及原住民族之間合理的定位該如何協調？

　　然而，原住民族傳統領域的空間概念與當代社會文化、法律制度間存在極大的差距，關於土地歸屬的根本問題，現行司法體系並沒有辦法妥當的處理。不僅臺灣面臨這樣的困境，澳洲、加拿大、阿拉斯加原住民、紐西蘭毛利人，各國各地皆有事例，成為我們的借鏡，提供其他可能的規畫面向，期待彼此能建立出協商合作的新模式。
