Mängel der Tatsachenfeststellung führen dazu, dass materielle Berechtigung und prozessuale Durchsetzbarkeit auseinanderfallen können. Um das zu verhindern, bedient sich die Rechtsprechung verschiedener Institute, die zum Teil ausdrücklich im Gesetz vorgesehen sind und teilweise von ihr (rechtsfortbildend) entwickelt wurden. Die Rechtsprechung ist von dem Versuch geprägt, jeweils Gerechtigkeit im Einzelfall herzustellen, worunter jedoch die Vorhersehbarkeit leidet. Der Gesetzgeber reagierte auf diesen unbefriedigenden Zustand mit Neujustierungen des Verhältnisses von Parteiherrschaft und Richtermacht, die freilich zu neuen Unsicherheiten führten. Raphael Koch zeigt - unter Berücksichtigung rechtsvergleichender Erkenntnisse - neue Wege zur Feststellung des Sachverhalts auf, die sich in eine einheitliche Struktur, Systematik und Dogmatik des Zivilprozesses einfügen.
