Sa pensée n'a pas cessé de nourrir des interrogations sur la signification de la justice sociale et politique et la fonction du droit et de l'Etat dans nos sociétés marquées par le pluralisme des conceptions de la vie bonne. A partir d'une analyse du principe de "l'inviolabilité de la personne humaine " et des droits de l'homme qui occupent une place importante dans la théorie de Rawls, cet ouvrage tente de montrer que la neutralité métaphysique de la théorie de la justice comme équité revendiquée par Rawls depuis son article de 1985 ("La théorie de la justice comme équité: politique, non pas métaphysique") introduit une faille importante dans sa théorie et atténue en même temps sa valeur comme théorie normative du droit et des institutions. L'auteur soutient en outre qu'il est possible de concilier l'exigence de tolérance et l'effort philosophique d'une fondation des droits et de la justice ayant une validité objective et universelle.
